Nuno Marques, Of Counsel in the Corporate, M&A and Private Equity practice at TELLES, signs an opinion article entitled “Control of foreign subsidies that distort the internal market and their impact on the M&A market”, published in the most recent edition of Advocatus magazine.
According to the TELLES lawyer, specialized in Corporate, M&A and Private Equity, “The Regulation intends to level the conditions of competition within the internal market, by creating procedures for ex officio analysis, prior notification of concentrations and award of public contracts in relation to entities that have received foreign subsidies. Without prejudice to the merits and intention of the Regulation, in such an important mission in a subject that is so much in need of regulation, the regulation does not arise without raising some concerns”.
"The creation of a mechanism for prior notification of mergers will have a clear impact on all M&A transactions, both in terms of time for concluding transactions and in terms of uncertainty", says Nuno Marques.
