Mariana Vicente signs article on Due Dilligence by Companies and Corporate Responsibility

Mariana Vicente, TELLES' trainee lawyer in the Commercial, Corporate and M&A practice area, is the author of an article on the “Proposed Directive on the Duty of Due Diligence by Companies and Corporate Responsibility – Summary Analysis of Articles 4-11”, published on the website of Investigation Research from NOVA University of Business, Human Rights and the Environment (NOVA BHRE).

According to Mariana Vicente, the new proposal imposes a duty of due diligence by large companies in the European Union, and others with significant operations over EU territory, with regard to the assessment of the impact of their operations in terms of human and environmental rights. The objective is to prevent, mitigate and remedy the identified damages. “Companies that do not comply with their duty of due diligence and do not implement preventive and reparative measures face administrative sanctions and civil responsability”, says Mariana Vicente.

TELLES’ trainee-lawyer adds that this “diploma brings several innovative solutions. Nevertheless there is room for further improvment. Once approved and applied, this diploma will symbolize a real earthquake, and will drive even the most careless companies in matters of human and environmental rights to become aware of them.”
