Sofia Pamplona, partner in the Labour and Social Security department at TELLES, was a guest on the Negócios à Lupa podcast, promoted by Associação Empresarial do Minho (AE Minho).
The labour law specialist analysed the draft amendment to labour legislation, emphasising that she does not foresee any major difficulties for companies with the bill, as it largely reinstates rules changed by the Decent Work Agenda and repeals those inserted by it. However, the draft bill falls short of what companies and workers had hoped for.
During the conversation, Sofia Pamplona addressed the most controversial points surrounding the government's proposed labour law reforms, namely the restriction of breastfeeding leave, the lifting of the ban on outsourcing, and the revocation of miscarriage leave. She also commented on the possible unconstitutionality of two provisions in the draft bill, which she believes do not violate any constitutional principle or right: the right of employers to oppose the reinstatement of workers in cases of unlawful dismissal, and changes to collective bargaining.
