RoundUp Labour | November 2025

TELLES' RoundUp Laboral is a monthly publication that highlights relevant legal trends and issues impacting the labour market in Portugal.

This edition, covering November 2025, highlights the analysis of the professional training for part-time workers, included in one of the proposals for the revision of the Labour Law presented by the Government.

A summary analysis of four judgments addressing relevant labour matters is also presented, namely:

(i) The Court of Appeal of Guimarães ruled that an audio recording couldn’t be used as evidence in dismissal proceedings by the plaintiff (employee). The court considered that this type of evidence can only be admitted in exceptional circumstances when it is truly indispensable for establishing the truth, which was not the case, since the employee had other resources to support her position;

(ii) The Supreme Court of Justice partially revoked the Court of Appeal's decision, determining that the option initially expressed by the employee in his request — reinstatement, in this case — should not be considered irrevocable. The Supreme Court, therefore, considered that until the end of the discussion at the final hearing, the employee may change his position and opt for compensation instead of reinstatement.

(iii) The Porto Court of Appeal's ruling that employers must retain employee documentation for ten years, emphasising the importance of rigorous document management in order to ensure transparency and legal compliance in the event of disputes.

(iv) The Supreme Court has ruled that overtime pay received for at least 11 months of the year should be included in an employee's pay for the purposes of calculating their vacation pay, vacation allowances and Christmas allowance.
