TELLES' RoundUp Labour is a monthly publication that highlights relevant legal trends and issues impacting the labour market in Portugal.
The following topics stand out in this seventh edition, which covers the month of July: (i) the launch of the new Social Security digital portal, which brings services together on a single website and represents a significant technological advance; and (ii) the technical note from the Portuguese Authority for Working Conditions (“ACT”), which reiterates the obligation of employers to refrain from contacting workers during their rest periods.
A summary analysis of the most relevant rulings of the month is also available. Topics covered include the constitutional validity of restrictions on outsourcing after collective redundancies, dismissal for just cause due to online defamation (thus reinforcing the importance of conduct outside work in preserving the trust inherent in the contractual relationship), employee negligence not excluding recognition of the concept of workplace accidents, and the prohibition of technological surveillance to monitor employee performance.
