Pedro Matias Pereira, managing associate in public law and urban planning practice at TELLES, wrote the article “Recent CJEU case law on objective modification of public contracts”, which was published in the latest edition of the Centre for Public Law and Regulation Studies (CEDIPRE) Newsletter.
The lawyer, who is specialised in public law, analyses two recent Court of Justice of the European Union (CJEU) decisions concerning the modification of public contracts: Fastned Deutschland (C-425/03) and Anib (C-728/22 and C-730/22).
In the opening lines, the author provides a brief overview of recent CJEU rulings: “In recent months, the Court of Justice of the European Union has ruled on two significant cases concerning the application of the regime for amending public contracts (as set out in the Public Procurement Directives). This is an important intervention regarding a regime that is still a source of legal uncertainty, particularly due to the use of indeterminate legal concepts (…)".
