Pedro Matias Pereira, partner in the Public Law and Urban Planning department at TELLES, has completed his PhD in Public Law, having passed his public examinations with distinction and honours.
The thesis, presented to the Faculty of Law of the University of Coimbra, is entitled "The Termination of Public Contracts on the Grounds of Invalidity" and focuses on the regime for the termination of public contracts provided for in Article 73 of Directive 2014/24/EU, which has not been specifically transposed into domestic law. The TELLES partner investigated whether the national legal system enables public contractors to terminate contracts to which they are party when the circumstances provided for in European Law occur (termination on grounds of invalidity).
Having reached the conclusion that the national law does not comply with the requirements of the Directive 2014/24/EU’ rule, the essential features of a national regime that correctly transposes the termination regime provided for in the Directive are identified, from a de iure condendo perspective.
