João Dotti de Carvalho, managing associate in the Labour and Social Security practice at TELLES, has written an opinion article entitled “Is the time for changes to Portuguese Labour Law finally arriving?”, which has been published in The Legal Industry Review. Portugal.
The lawyer, specialised in labour law, has noted that, after months of political uncertainty and successive postponements, the government has returned to the issue of labour reform, presenting a set of proposals aimed at promoting the flexibility, productivity and competitiveness of Portuguese companies. These proposals seek to adjust labour legislation to the challenges of the digital economy and the reality of an increasingly global and dynamic market.
“With immediate challenges such as artificial intelligence and ESG – including the implementation of the European Pay Transparency Directive by 2026, which requires companies to pay greater attention to pay equity, particularly between genders – it has become imperative to create conditions that allow Portuguese companies to increase productivity and wages, thereby becoming more competitive. To achieve this, it is essential and urgent that companies are provided with simpler, more modern, and flexible labour legislation that adapts to an increasingly global and dynamic reality. This legislation must also update the legal framework to address the challenges of the digital age, introducing differentiated regulations for remote working, platform-based work, economically dependent work, and digital nomadism”, stresses the lawyer.
Despite his optimism about the future, the lawyer points out that “it is almost 2025 and we are still far from seeing these measures in place.”
