Leyre Prieto, partner and head of European Law and Competition practice at TELLES, and Joana Whyte, associate in the same practice area, were interviewed by Lexology in the article entitled “An Interview with TELLES Advogados discussing Cartels in Portugal”, where they shared their insights on cartel enforcement and broader anti-competitive practices in the Portuguese market.
In the interview, the TELLES lawyers focus on the work of the Competition Authority (AdC), highlighting its growing activity in the investigation and repression of competition law infringements. They point out that in 2022 alone, the PCA issued five notices of illegality, sanctioned 12 companies with fines totalling 490 million euros, carried out six dawn raids and received eight leniency applications - the highest number since the creation of this mechanism in Portugal.
They further emphasise that “the PCA has been strengthening its toolbox to promote competition and facilitate the detection of anticompetitive behaviour, especially in digital markets”.
Leyre Prieto and Joana Whyte also underline that “cartel enforcement is still one of the PCA’s priorities. In our opinion, cartel enforcement is most likely to have a particular focus in the digital environment since this is one of the PCA’s top priorities for 2023.”
